By accessing or using the website at palmcoastsunroomcontractor.com or by engaging the services of Palm Coast Lanai Sunrooms & Patios ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or engage our services. We may update these terms at any time. The version posted on our website at the time of your engagement governs your project.
Palm Coast Lanai Sunrooms & Patios provides residential sunroom construction, patio enclosure, screen room installation, and related outdoor-living improvement services in Palm Coast, FL and surrounding communities. All work is performed by or under the direct supervision of our licensed team. Specific services, scope of work, materials, and timelines are described in each individual written proposal or contract provided to the customer before work begins.
Our website provides general information about our services. It does not constitute an offer or guarantee of specific pricing, availability, or project timelines. All project details must be confirmed in a signed written agreement.
Written estimates are provided after an on-site consultation and are based on the scope of work as understood at the time of the estimate. Estimates are not binding contracts. A signed written agreement is required before any work begins.
Project pricing is fixed as stated in the signed agreement. Any changes to the scope of work requested by the customer after signing - including additions, deletions, or material substitutions - will be addressed through a written change order, which must be approved by both parties before the changed work proceeds. Change orders may affect both price and timeline.
Unforeseen site conditions discovered after work begins - such as hidden structural issues, soil conditions requiring additional preparation, or pre-existing damage - may require a change order. We will notify you promptly and obtain your written approval before proceeding with any work that affects the agreed price.
Project start dates are estimates and are subject to permit approval timelines, material availability, weather, and scheduling constraints. We will communicate any material delays as soon as we are aware of them.
If you need to cancel or reschedule a project after signing an agreement, please notify us in writing as soon as possible. Cancellation terms, including any deposits that may be retained to cover costs already incurred, will be specified in your signed agreement. If we are unable to begin or complete a project due to circumstances outside our control - including permit denials or customer-requested holds - we will work with you in good faith to reschedule.
Payment terms are specified in each signed project agreement. Most residential projects require a deposit before work begins, with progress payments at defined stages of completion and a final payment upon project completion. Invoices are due upon receipt unless a different schedule is stated in the agreement.
Late payments may be subject to interest charges as permitted by Florida law. We reserve the right to suspend work on a project if a required payment is not received within the time stated in the agreement. Suspended work may affect project timelines and scheduling.
We handle the permit application process for all projects that require a building permit in Palm Coast and surrounding jurisdictions. Permit fees are typically included in the project price as stated in the signed agreement. We schedule all required inspections and will provide you with copies of completed inspection records and certificates of completion.
Permits are issued by the applicable local authority and are subject to that authority's approval timeline. We are not responsible for delays caused by government permit review timelines.
We stand behind our workmanship. Any warranty on labor is specified in your signed project agreement. Materials and products used in your project are covered by the manufacturer's warranty, which varies by product. We will assist you in understanding what manufacturer warranties apply to your project and how to make a claim if needed.
Our warranties do not cover damage caused by misuse, improper maintenance, acts of nature (including hurricanes and flooding), or modifications made to the completed work by parties other than us. Our website and all information on it are provided "as is" without warranties of any kind.
To the fullest extent permitted by Florida law, our total liability for any claim arising from a project or from use of our website is limited to the amount paid by you for the specific work giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages of any kind.
We are not responsible for damage caused by pre-existing conditions on your property that were not disclosed to us before work began, or for conditions that could not reasonably have been identified during our on-site consultation.
You agree to provide accurate information about your property, including disclosure of known structural issues, underground utilities, HOA requirements, and any easements or restrictions that may affect the project. You agree to ensure that the work area is accessible and free of obstructions before scheduled work dates. Failure to do so may result in a rescheduling fee or project delay.
If your property is governed by a homeowners association, you are responsible for obtaining any required HOA approval before work begins. We can assist you in preparing HOA submission documents, but final responsibility for HOA compliance rests with the property owner.
If a dispute arises between you and Palm Coast Lanai Sunrooms & Patios, we ask that you contact us first to try to resolve the issue directly. Most concerns can be addressed quickly through direct communication. If we are unable to resolve the dispute informally, the parties agree to attempt mediation before pursuing any other legal remedy.
Any unresolved dispute will be subject to the jurisdiction of the courts of Florida, in the county where the project was performed.
These Terms and Conditions are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising from your use of our website or our services must be brought in the appropriate courts of Florida.
We reserve the right to update these Terms and Conditions at any time. Changes take effect when posted to our website. The effective date at the top of this page reflects the date of the most recent revision. We encourage you to review these terms periodically. Your continued use of our website after changes are posted constitutes acceptance of the revised terms.
